December 19, 2017 Meeting Notes


Peotone Township Regular Meeting

Supervisor Cann called the December meeting of Peotone Township to order at 7:00 P.M. on December 19, 2017.


Randy Swartz led the Pledge of Allegiance.


The Roll Call indicated all were present except Assessor Latham.


The minutes of the November 20, 2017 meeting were presented. A motion to accept the minutes as presented was made by Trustee Morgan and was seconded by Trustee Heisner. On a roll call vote, the following members voted “yes”: Morgan, Schubbe, Swartz, Heisner and Cann. Motion carried unanimously.
There were no visitors were in attendance.


The Town Fund Budget Report was submitted. A motion to accept was made by Trustee Schubbe and seconded by Trustee Swartz. On a roll call vote, the following voted “yes”: Morgan, Schubbe, Swartz, Heisner and Cann. Motion carried unanimously.


The Road District Funds Budget Report was submitted. A motion to accept was made by Trustee Swartz and seconded by Trustee Morgan. On a roll call vote, the following voted “yes”: Morgan, Schubbe, Swartz, Heisner and Cann. Motion carried unanimously.
The Financial Summary Report was submitted. A motion to accept was made by Trustee Schubbe and seconded by Trustee Swartz. On a roll call vote, the following voted “yes”: Morgan, Schubbe, Swartz, Heisner and Cann. Motion carried unanimously.


The Town Fund bills were then submitted. A motion to pay these bills was made by Trustee Morgan and seconded by Trustee Heisner. On a roll call vote, the following voted “yes”: Morgan, Schubbe, Swartz, Heisner and Cann. Motion carried unanimously.


The Road & Bridge, Hard Road and Equipment Funds bills were then submitted. A motion to pay these bills was made by Trustee Schubbe and seconded by Trustee Heisner. On a roll call vote, the following voted “yes”: Morgan, Schubbe, Swartz, Heisner and Cann. Motion carried unanimously.


Under Additions to the Agenda, nothing was added.


Under Planning & Zoning, Supervisor Cann shared a letter for the Tax Objection Court Case #17 TX 295 by Chester Borsuk for his property on 11018 W. Wilmington Road, Peotone, IL. That meeting has been set for January 10, 2018 at 9:00 am in Courtroom 236 in the Will County Court Annex Bld.


The following correspondence was received:

  • Supervisor Cann completed and mailed the Certificate of Status of Exempt Property for the Peotone Township property to Will County on 12/12/2107.
  • Notification received from the Village of Peotone that the TIF Public Meeting for Dec. 5th was cancelled. A new Joint Meeting has been set for Jan. 4, 2018 and the Public Meeting for Feb. 12, 2018.
  • Chamber of Commerce invitation to Peotone Township to signup for free 2018 membership.


Under Old Business, Trustee Heisner asked if there has been any progress regarding weight limit signage for the County Line Road & Bridge for trucks. Road Commissioner Hack stated that the WC Sheriff’s Department informed him there is nothing more that can be done. The current limit for hard roads is 80,000 lbs. and any restrictions would require an IDOT change. Trustee Morgan offered to contact Judy Ogalla. He will invite her and possibly the WC Sheriff’s Officer that specializes in trucks to a future Township meeting.


Under New Business, there was nothing to discuss.


Assessor Latham was absent so there was nothing to report.


Road Commissioner Hack had nothing new to report.


Supervisor Cann distributed a copy of the Illinois Township Code, (60 ILCS 1/Art. 60) Article 60 – Vacancies in Township Offices and the Manner of Filling Them (see attached). He reviewed the state requirements for this. The key points reviewed are highlighted below:

  • If an office becomes vacant by resignation, the Township Board shall fill the vacancy by appointment and the person appointed shall hold the office for the remainder of the unexpired term.
  • The Township Board has 60 days to fill any vacancy otherwise a special township meeting must be called to do so.
  • Any person appointed must be of the same political party as the person vacating the office.
  • Resignations become effective upon acceptance by the Township Board.

Supervisor Cann stated that he planned to resign. Before doing so, he recommended that the Township Board strongly consider Clerk Younker to be appointed to the Supervisor office once vacated.  Supervisor Cann cited Clerk Younker’s background and many years of service as both a Trustee and Clerk as qualifications worthy to hold the office of Supervisor. Supervisor Cann then read his letter of resignation (see attached) dated Dec. 18, 2017:


“Dear Peotone Township Board, It has been a pleasure working with you for the past 29 years as Trustee, Clerk and Supervisor. It is with a heavy heart that I tender by resignation as Supervisor, effective immediately. I am doing so for personal reasons and ask that you respect mine and my family’s privacy. I thank you again for the opportunity to serve you and the people of Peotone Township.
Respectfully Submitted, David W. Cann”


The Township Board accepted his resignation and expressed their deep appreciation for his many years of dedicated service. The Township Board discussed filling the open office of Supervisor and agreed that Clerk Younker would be their choice. Clerk Younker offered his resignation of his Clerk’s office, which the Township Board accepted. The Peotone Township Board then, by warrant under their signatures and seals, appointed Gene Younker to the office of Supervisor to fill the remainder of the unexpired term. The Township Board discussed some options to fill the now vacant Clerk’s position.  Trustees Heisner and Swartz expressed interest but wanted to learn more about the responsibilities before any decisions would be made. The Township Board agreed to hold on any appointment action until next meeting. That would allow Supervisor Younker to meet with both Trustee Heisner and Trustee Swartz to review the duties of the Clerk with them.


Being no other reports or comments from the Board, a motion to adjourn was made by Trustee Swartz and seconded by Trustee Schubbe at 7:49 P.M. The motion was unanimously accepted.
