Participants in the Random Drug and Alcohol Program must have a CDL License. Therefore, the following information provided to us by Midwest Truckers is important to you. Please take the time and read the following carefully.
LOSS OF CDL PRIVILEGES - Commercial drivers license (CDL) holders should be aware of new regulations that can cause a loss of CDL privileges for major traffic offenses committed in their personal vehicle.
Two notable changes affect refusal to submit to an alcohol test while driving a personal vehicle and driving under the influence in a personal vehicle. A CDL holder, who refuses to take an alcohol test, even while driving their personal vehicle, will result in losing their CDL privilege for one year. Furthermore, if a CDL holder takes an alcohol test resulting in an alcohol concentration above 0.08, the Illinois Secretary of State will automatically issue the driver a one-year summary suspension of all driving privileges, effective 46 days after the incident. The summary suspension is given without conviction in a court of law. If the CDL holder goes to court and is convicted of a DUI in his personal vehicle, the driver will lose his CDL privileges for a year. Also, CDL holders are no longer eligible to receive judicial driving permits (work permits). If the CDL holder goes to court and is not convicted of a DUI, then the driver's CDL privileges will be re-established by the Illinois Secretary of State.
If you have not done so already, you may want to put a provision in your employee handbook or employer policy to cover the disciplinary action if your driver gets a DUI or refuses to submit to an alcohol test while in their personal vehicle.
